Terminology

When we use terms like "we," "our," or "us" in these Terms, we are talking about aliveorwhat.com. By using aliveorwhat.com, you, as well as the person you choose to be your trusted contact, are agreeing to these Terms as well as the Privacy Policy linked on the Platform. Please take the time to read these Terms, and feel free to get in touch if you have any questions. If you do not agree with these Terms, please do not use aliveorwhat.com.

Changes to these Terms

We may need to change these Terms from time-to-time to reflect updates, changes to the Platform, legal or other reasons, or otherwise to protect our legitimate interests. We can make these changes at any time and it is your responsibility to check these Terms now and then for any changes.

Your continued use of aliveorwhat.com after any changes to the Terms is taken as your acceptance of the revised Terms.

Your account

To create an account you agree to comply with these Terms and that you are at least 13 years old and over the minimum age required by the laws of your country of residence to access and use our services. You are responsible for your account and ensuring it is only used lawfully. You agree that you can form a binding contract with aliveorwhat.com, or, if you are over 13 but under the age of majority in your jurisdiction, that your legal guardian has reviewed and agrees to these Terms.

By accessing or using our service, you represent and warrant that you are an individual person and not a corporation, partnership, or any other type of business entity. Our service is intended solely for use by individuals who are at least 13 years old and who can form legally binding contracts under applicable law.

Any registration or account created by a business entity or on behalf of a business entity will be deemed invalid, and we reserve the right to terminate any such accounts without notice. By using our service, you agree to comply with this eligibility requirement and acknowledge that any violation may result in the suspension or termination of your account.

Payments and cancellation

You can sign up to aliveorwhat.com and try it out for free for a limited time after which you need to use the paid plan in order to continue using our services. We do not use any recurring payments or subscriptions. It is a one-time payment, which you can do from within the dashboard.

If you want to delete your account you can do so easily from within the dashboard.

Refunds

Since you have the option to try out an account for free, we do not issue refunds.

Your content

When we talk about your "content", we mean the text, links, and any other materials you add to your aliveorwhat.com profile. You are responsible for your content and you warrant that the content you post is yours, or if you are using third-party materials, you have the necessary rights to share them on aliveorwhat.com (and allow us to use them as per these Terms), and that your content will not infringe on the privacy, publicity, intellectual property, or any other rights on anyone. You also warrant that your content is accurate and honest and that it does not violate any laws or harm our reputation. You also warrant that your content is free from harmful elements that could damage the Platform or other systems and that you will refrain from posting ads, solicitations, or endorsements on aliveorwhat.com.

We reserve the right to take appropriate steps to keep aliveorwhat.com safe, including content removal or access restriction.

Your Page ID and display name

When you create an account, you need to choose a suitable Page ID (also called a handle). Page IDs are distributed on a first-come, first-serve basis. We understand that your Page ID may hold significance, but it must also be appropriate.

Page IDs, display names, etc., must be respectful and appropriate for all audiences. The use of profanity, vulgarity, hate speech, or blasphemous language is prohibited. This includes, but is not limited to, words or phrases that are obscene, defamatory, discriminatory, or disrespectful towards any individual, group, or belief system.

We reserve the right to remove any account that violates this policy. Users are solely responsible for the content of their account and agree to indemnify the platform for any legal claims arising from their content.

Page ID disputes

Since we are a small project and do not have large legal departments, we outsource all Page ID disputes to older established social networks. What this means is that if a person is using the same name on at least two popular networks, such as e.g. YouTube, Twitch, X (Twitter) or Facebook, or such person has registered a .com domain with the same name, and such accounts or domain name were registered before the creation of the account on aliveorwhat.com, and no other such account name exists on other popular networks by other persons, we might consider the name to be part of their online identity and will be willing to give them that as their Page ID, should they contact us and ask for it (providing the relevant proof).

If you have provided us with an email address, you will have the chance to get notified and we can change your Page ID to something else, or you have the option to dispute the issue. If you have not provided us with a valid email address, we will have no means of contacting you, as a result, your account may be deleted.

You can avoid all such disputes by making sure that you are not using something that is already used on a .com domain or on any of the popular social networks.

Liability

We want to clarify that we are not responsible for how you use aliveorwhat.com, and it is crucial that you maintain backups of your content. We are not liable for any damages resulting from utilizing aliveorwhat.com. You agree to protect us from any losses that arise if you breach these Terms or if a third party raises a claim against us related to your content. We will not be liable for indirect, punitive, special, incidental, or consequential damages. These might include losses in business, revenue, profits, privacy, data, goodwill, or other economic benefits. This applies whether the issue stems from a contract breach, negligence, or any other cause, even if we were aware of the potential for such damages.

When you use aliveorwhat.com, you are doing so at your own risk. aliveorwhat.com is provided to you "AS IS" and "AS AVAILABLE", without any warranties of any kind, whether they are expressed or implied, including (but not limited to), up-time or availability.

These Terms apply to the maximum extent permitted by law and nothing in them is intended to exclude, restrict or modify legal rights that you may have, which cannot be excluded, restricted or modified by contract.

Third Party Services

aliveorwhat.com collaborates with a few third-party services, such as a payment gateway and a hosting service. Unless explicitly stated otherwise, we do not endorse or make any warranties about any third-party products or services, nor do we offer refunds for payments made to third parties. Your use of any third-party product or service may be subject to separate terms and conditions, which you are responsible for reviewing, accepting, and complying with. Failure to accept or adhere to these third-party terms may result in the suspension, cancellation, or limitation of your account or access to these services on aliveorwhat.com.
